Terms of sale

1. Scope and provider

These terms apply to orders on giftmelody.com between the provider named in the legal notice and consumers. The contractual language is German.

2. Service

We create a personalized song, lyrics and music, using your information and AI. The MP3 is available to listen to and download. Melody, voice and arrangement cannot be predicted exactly. A free preview of about 45 seconds is available before purchase.

3. Formation of the contract

The questionnaire and preview are non-binding. By clicking the payment button and completing payment, you submit a binding offer. The contract is formed when payment is confirmed and the song is unlocked. The contract text and order details are provided by email.

4. Prices and payment

The displayed prices apply: song €49.00, optional gift pack €14.90. Payments are processed by the providers shown at checkout.

Final prices include applicable statutory VAT.

5. Delivery

After payment is confirmed, the full song is unlocked on your song page. Its link is also sent by email.

6. Correction

If a name is mispronounced or the lyrics contain a factual error related to your information, one new version may be requested free of charge within 14 days of purchase. Your statutory warranty rights remain unchanged.

7. Withdrawal

You have a statutory right of withdrawal. For digital content, it ends when delivery begins after your express agreement to start before the withdrawal period expires and your acknowledgement of losing that right (§ 356(5) BGB). See the withdrawal notice.

8. Use

You may keep, give, play and share the song for personal use without a time limit, including on personal social accounts. Commercial use, resale or monetized distribution are not allowed. AI creation does not guarantee that copyright exists in the result or that it will not resemble other works.

9. Your information

Your information must not infringe others' rights or contain insulting, unlawful or discriminatory content. We may reject such orders.

10. Liability

Liability is unlimited for intent or gross negligence, injury to life, body or health, and under the Product Liability Act. For slight negligence affecting essential contractual obligations, liability is limited to foreseeable damage typical of the contract. Otherwise liability is excluded.

11. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules in your country of habitual residence remain unaffected.
